Terms and Conditions of Use of the Online Store (E-shop)


By entering and browsing this website and/or using any of its content or services (hereinafter the "Website"), you declare that you have read and unconditionally accept these terms of use. In the event that you do not agree, in whole or in part, with these terms, you must refrain from using the Website and the services provided through it.

The Website www.proofofconcept.gr is managed by the Social Cooperative Enterprise of Collective and Social Benefit under the name "Συνεταιρισμός Ανεξάρτητων Καλλιτεχνών και Σχεδιαστών – ΚΟΙΝ.Σ.ΕΠ.» " (hereinafter referred to as "Proof of Concept", "the Enterprise", "we", or "our"). The Enterprise is legally established and operating in Greece, with VAT number 996456471, General Electronic Commercial Registry (G.E.MI.) number 177484861000, under the jurisdiction of the KEFODE Attica Tax Office, and headquartered at 9 Lykourgou Street, P.C. 105 51, Athens. These terms of use, in conjunction with the prices posted on the Website, the delivery terms, the contact details, and the return policy, constitute the entire contractual agreement between the Enterprise and the respective user or buyer, regarding the supply of products through the online store. Any statements or terms of third-party sellers or partners cannot modify or negate these terms.

The Enterprise reserves the right to modify the terms of use at any time. The user is obliged to check their content before any transaction. Any modifications do not affect orders that have already been completed, unless this is required by mandatory provisions of law. The continued use of the Website following a modification of the terms constitutes a presumption of their acceptance.

Access to and use of the Website is provided exclusively for private and personal purposes. Any commercial exploitation or use of the Website for any other purpose without the prior written consent of the Enterprise is expressly prohibited. The user bears full responsibility for any action or activity carried out through the Website. In the event of a breach of these terms, the Enterprise may restrict or terminate, temporarily or permanently, the user's access to the Website without prior notice.

1. User Account Creation and Management

The creation of a personal account is a prerequisite for the full utilization of the Website's functions and services. During the registration process, the user is obliged to provide true, updated, and complete personal information. The password set during registration must be unique and kept strictly confidential. The user bears exclusive responsibility for safeguarding their login credentials and is obliged to immediately notify the Enterprise in the event of any unauthorized use of their account.

Upon successful account creation, the user acquires, among others, the following capabilities:

  • Access to the full history of their orders and purchases.

  • Storage of shipping details, which automatically appear during the checkout of future purchases.

 

The "Login / Register" option is available on every page of the Website, in the top right corner. In the case of access via a mobile device or tablet, this option is located in the main navigation menu (burger menu). By selecting this option, the user is directed to the relevant page, where they fill in the required details and complete the process by clicking the "Register" button.

 

Through the "My Account" section, the user has the ability to:

  • View their order history.

  • Manage their account details, including changing their name, password, and other personal data.

  • Register, modify, or update shipping and billing addresses.

If the user wishes to delete their account or unsubscribe from receiving informational communications, they can send a relevant request via email to info@proofofconcept.gr, and their request will be processed as soon as possible.

2. Conditions for Making a Purchase

To complete purchases through the Website, the user is required to disclose certain personal information, such as their full and true name, contact telephone number, email address, as well as any additional information required by the relevant online form. By submitting an order, the user declares and warrants that the billing information entered is accurate, valid, and complete, and that they possess the legal capacity to use the selected payment method. The execution of the payment is finalized upon the acceptance of the order by the Enterprise.

By placing an order, the user confirms that they are the legitimate holder or authorized user of the stated payment details. Account creation and the execution of transactions are permitted exclusively to individuals who have reached the eighteenth (18th) year of age. The Enterprise does not accept, under any circumstances, transactions carried out by minors.

 

Access to the Website and the ability to make purchases are provided only to users who:

  • Have unconditionally accepted these terms of use.

  • Possess a valid payment method accepted by the Enterprise, such as a debit or credit card, or have agreed to settle the total amount via bank deposit to an account held by the Enterprise.

  • Have provided explicit authorization to the Enterprise to charge the selected payment method with the exact amount corresponding to the respective order.

3. Order Process and Conclusion of Sales Contract

All orders are subject to availability. Adding products to the shopping cart does not constitute a reservation thereof, as the same products may be simultaneously available to other users until the final completion of the transaction.

Please note that some products require 1–7 days to be made.

The checkout process initiates from the cart page, where a detailed presentation of the selected products is displayed. The user has the ability to remove products, modify quantities, or apply a discount code, where applicable. After confirming the contents of the cart and selecting a shipping method, the user is informed of the respective costs and the total order amount, and may proceed to the payment stage.

On the "Checkout" page, the user is obliged to fill in the required billing details. The completion of the aforementioned details is mandatory even if "pickup from headquarters" is selected.

During the process, the user is prompted to choose one of the available shipping methods, which indicatively include:

  • Pickup from headquarters, upon prior arrangement.

  • Delivery via courier company, with an estimated delivery time of 1–5 business days.

  • Free shipping, which is provided exclusively for orders with a total value exceeding €70.00, for shipments within Greece.

 

Subsequently, the user selects the desired payment method, which varies depending on the chosen shipping or pickup method.

The following payment methods are available in case of selecting delivery via courier:

  • Debit or credit card, through the secure environment of Stripe.

  • Bank Transfer: You may deposit the order amount into one of our bank accounts. After completing the deposit, please notify us via email so that we can confirm your payment.

 

In the case of pickup from the physical store, the additional option of payment via cash on delivery upon receipt is available.

 

Upon the successful completion of the transaction, a confirmation email containing the order details is sent to the user.

 

The Enterprise reserves the right to cancel an order, particularly in the following cases:

  • Non-approval or failure of payment.

  • Objective inability to deliver to the declared area.

  • Non-acceptance of the Website's terms of use.

  • Obvious display of an incorrect price due to a technical or typographical error.

 

The user may request the cancellation of the order within one (1) hour of its placement. In the event of a refund, the crediting time depends on the selected payment method and is communicated to the user via email or telephone.

 

In the case of selecting pickup from the store, the user is obliged to collect the order within ten (10) days. The Enterprise reserves the right to restrict future service in cases of repeated, unjustified cancellations.

 

The option to pre-order products that have not yet been released is also provided. The estimated release date is stated on the respective product page. Payment is made at the time of submitting the pre-order, and shipment is executed on the next business day following the official release. Any changes to the release date are communicated to the user in a timely manner. Requests for pre-order cancellation must be submitted prior to the release date via the Enterprise's stated contact details.

Card payments are processed through Stripe, without the requirement of creating an additional account, in a fully secure environment. Stripe is an internationally recognized and licensed payment service provider and implements certified security standards (PCI DSS), modern encryption technologies, and data protection systems, in accordance with applicable legislation.

4. Pricing Policy and Payment Methods

All transactions carried out through the Website are processed in Euros (€), given that the Enterprise's headquarters are located in Athens, Greece. In the event that the payment method (e.g., card or bank account) does not hold a balance in Euros, the final charge amount will be converted at the corresponding exchange rate on the day the transaction is executed.

 

Product shipping costs are borne exclusively by the user and are added to the total order amount during checkout.

 

In the case of selecting delivery via courier, the user has the following available payment methods:

  • Debit or credit card, through the secure environment of Stripe.

  • Bank Transfer: You may deposit the order amount into one of our bank accounts.

  • If you choose to pay by bank transfer, please include your Order ID as the payment reference and send us the proof of payment. Your order will not be shipped until the funds have been credited to our account.

The processing of such data is carried out in accordance with Klarna's privacy policy.

 

The Enterprise reserves the right to modify product prices at any time and without prior notice.

Value Added Tax (VAT) is calculated in advance at a rate of 24% and is included in the total amount of every transaction carried out within Greece.

5. Shipping and Delivery Policy

 

Within Greece

Deliveries within Attica are carried out within 1–3 business days, while for other regions of Greece, including mainland and island destinations, the delivery time ranges from 1–4 business days. All domestic shipments are processed in collaboration with the companies ELTA courier and Box Now.

The shipping cost depends on the selected delivery method. If you do not wish to incur shipping costs, you may collect your order directly from the Enterprise's physical store, located at 9 Lykourgou Street, Athens - Omonia, 10551, upon prior arrangement. For orders exceeding €70.00, shipping is provided free of charge, regardless of the payment method.

 

Outside Greece
For international shipments, please contact us via email before completing your order, as shipments are carried out on a case-by-case basis and upon arrangement.

Shipments to Cyprus are carried out via Box Now.

 

The remaining international shipments are carried out via DHL, with shipping costs formulated according to the respective destination. Delivery time depends on the place of delivery.

 

For orders with a value exceeding €150.00, international shipping is provided free of charge.

 

Customers outside the European Union may be subject to additional charges, such as exchange rate differences, customs duties, import taxes, or other surcharges imposed by the destination country. The Enterprise bears no responsibility for such charges or restrictions arising from local legislation.

 

6. Transport Security and Delivery Responsibility

The Enterprise undertakes the insurance of every product from the moment the purchase is completed until its delivery to the customer.

In the event of non-delivery of the order due to the exclusive fault of the carrier, the Enterprise commits to repeating the delivery within seven (7) business days, without any charge to the customer.

All products are dispatched in special protective packaging to ensure they reach the customer in perfect condition. In the event of receiving a product with visibly damaged packaging, the Enterprise bears no responsibility for the potential damage to the product. The customer is urged to contact the Enterprise immediately so that the damage can be examined and, if verified, proceed with the replacement of the order.

The Enterprise is not liable for delays or non-delivery of products caused by circumstances of force majeure.
Deliveries are made to the address declared by the user during the order process. The customer bears full responsibility for the accuracy of the entered shipping details. The Enterprise is not responsible for any non-delivery or delay due to incorrect shipping details. In the event of an order return due to non-receipt or inability of the carrier to complete the delivery, the reshipment costs are borne exclusively by the customer.

7. Exchange Policy

The Company offers the possibility to exchange products within 30 calendar days from the date of receipt. Please note that earrings are excluded from the right of return or exchange for hygiene reasons. For the exchange to take place, the returned product must:

  • not have been used,

  • be in perfect condition, exactly as before the sale,

  • be returned in its complete original packaging along with all packaging contents (box, inserts, etc.), without any damage or alteration.

 

For your first exchange, the return shipping cost is free for orders within Greece; in any other circumstance, the cost is borne by the buyer. To register your request and initiate the exchange process, please send us an email at info@proofofconcept.gr with your details and the products you wish to exchange, or call us at +30 213 0884403.

 

Upon receipt and inspection of the product, provided it meets the requirements, a discount coupon code of equivalent value will be sent to you for your new selection. The new order is placed normally, and the coupon code is entered in the designated field during checkout.

 

Alternatively, if feasible, after contacting us, you may bring the product directly to the Company's headquarters for an exchange or replacement, bypassing shipping.

 

Defective Products & Incorrect Shipments

 

Incorrect product or transit damage: In case you receive an incorrect product or notice that the product has suffered damage during transport, please contact us as soon as possible, and within 48 hours of receipt. Immediate notification helps us resolve the issue quickly and take the necessary actions with the courier company.

 

Manufacturing defect (Legal Guarantee): The Company is liable for actual (manufacturing) defects of its products, in accordance with the provisions of the Greek Civil Code and consumer protection legislation. If the product you purchased presents a manufacturing defect, please contact us to examine the issue. Once the defect is confirmed, you have the right to free repair or replacement of the product, and if this is not feasible, the right to a price reduction or cancellation of the sale.

In any case of a proven defect or an error on our part regarding the shipment, the cost of return and reshipment is borne exclusively by our company.

 

The Company is committed to serving its customers in the best possible way, fully respecting their rights. However, in the event of repeated returns by the same consumer, indicating an intention to exploit the exchange/withdrawal policy (e.g., systematic ordering and returning of products without reasonable cause, indications that the products have been used beyond the necessary testing), the Company reserves the right to:

  • Reject the return/exchange request if the products do not meet the perfect condition requirements.

  • Refuse the acceptance and execution of future orders from the specific customer, invoking the abusive exercise of the right of withdrawal (Article 281 of the Greek Civil Code).

 

 

8. Right of Withdrawal

The customer has the right to withdraw from the purchase within 14 calendar days from receipt, without providing any justification for their decision. The product must be returned in perfect condition, exactly as received, in its complete original packaging and with all contents. To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract with a clear statement before the aforementioned 14-day deadline expires. You can fill out the withdrawal form found here.

In case of withdrawal, you have the option to choose either a refund or the issuance of a credit coupon/exchange for another product. Refunds are processed within 14 days from the receipt of the product, using the same payment method originally used, unless otherwise agreed. If you withdraw from the sales contract, we will refund all payments received from you, including delivery costs, provided you had chosen the cheapest standard delivery method offered by our company.

 

The return can be made via BOX NOW or any courier of your choice, at your own expense. The customer bears only the return shipping cost, unless the return is made directly at the Company's headquarters. In case of failure to comply with the above terms, the Company reserves the right to reject the withdrawal.

For health protection and personal hygiene assurance, we inform our customers that:

  • Returns or exchanges on earrings are not accepted, as they are considered personal use items that come into direct contact with the skin.

  • Products manufactured upon special order (e.g., jewelry with custom engravings, specific chain lengths, or personalized designs) are also excluded from the right of withdrawal.​

9. Intellectual Property and Use Restrictions

All content on the site, including photographs, texts, logos, HTML code, and other programs or software elements, constitutes the intellectual property of the Enterprise and is protected in accordance with Law 2121/1993 "On Copyright, Related Rights and Cultural Matters", reserving all rights not expressly granted to users.

The reproduction, redistribution, or use of the site's content without the prior written permission of the Enterprise is prohibited.

The Enterprise bears no responsibility for any damage suffered by the user or visitor of the site from the use of the content, services, or options of the site. Furthermore, no warranty is provided that the servers or the linked websites related to the site's services are free of viruses, malware, or other harmful elements. It is recommended that all users have updated and active antivirus software for the secure browsing and use of the site.

10. Applicable Law, Jurisdiction, and Dispute Resolution

All terms of use of our site, along with the payment policies and procedures for products, are governed and interpreted in accordance with the applicable legislation regarding electronic commerce and distance sales. Their application complies with both European law and Greek legislation, specifically: In the event that any dispute arises between the company "Cooperative of Independent Artists and Designers - KOIN.S.EP." and the customer, jurisdiction rests with the Courts of Athens.

Out-of-Court Dispute Resolution The customer may request an out-of-court settlement of the dispute by addressing the competent bodies, such as:

In accordance with Directive 2013/11/EU, incorporated into Greek law by Joint Ministerial Decision 70330/2015, there is now the possibility of online resolution of consumer disputes for buyers within the EU, via the platform: https://webgate.ec.europa.eu/odr/main/?event=main.home.show.

Important Notice : The protection provided by the provisions regarding distance contracts and these terms applies only to natural persons making purchases for personal and non-professional purposes, and not for business, commercial, or professional activity.
